Apotique B.V. cares a lot about your privacy. Therefore, we only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Apotique B.V.. The effective date for the validity of these terms is 26/09/2020; with the publication of a new version, the validity of all previous versions ceases. This privacy policy describes what data about you is collected by us, how this data is used, and with whom and under what conditions this data may be shared with third parties. We also explain to you how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you have provided to us.

About data processing

Ecommerce software

Shopify

Our online store is developed with software from Shopify. Personal data that you provide to us for our services will be shared with this party. Shopify has access to your data to provide us with (technical) support, they will never use your data for any other purpose. Shopify is obligated, based on the agreement we have with them, to take appropriate security measures. These security measures consist of the application of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own organization to further improve the service. Shopify takes into account the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, your data may be processed in the United States.

Web hosting

We obtain web hosting and email services from Argeweb. Argeweb processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Argeweb has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Argeweb is obligated to confidentiality under the agreement.

 Email and mailing lists

MailChimp

We send our email newsletters using MailChimp. MailChimp will never use your name and email address for its own purposes. At the bottom of each email that is automatically sent via our website, you will see the 'unsubscribe' link. You will no longer receive our newsletter. Your personal data is securely stored by MailChimp. MailChimp uses cookies and other internet technologies that provide insight into whether emails are opened and read. MailChimp reserves the right to use your data to further improve the service and, in this context, share information with third parties.

We use the services of Argeweb for our regular business email communication. This party has taken appropriate technical and organizational measures to prevent abuse, loss, and corruption of your and our data as much as possible. Argeweb does not have access to our mailbox and we treat all our email communication confidentially.

Payment processors

Mollie

For processing (part of) the payments in our online store, we use the platform of Mollie. Mollie processes your name, address, and residence details, as well as your payment information such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and, in this context, share (anonymized) data with third parties. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie's service for which they engage third parties. Mollie does not retain your data longer than permitted by legal terms.

Shipping and logistics

 PostNL

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of PostNL to carry out the deliveries. It is necessary for us to share your name, address, and residence details with PostNL. PostNL uses this information solely for the purpose of executing the agreement. In the event that PostNL engages subcontractors, PostNL will also make your data available to these parties.

DHL

When you place an order with us, it is our responsibility to deliver your package to you. We use the services of DHL for carrying out the deliveries. It is necessary for us to share your name, address, and residence details with DHL. DHL uses this information solely for the purpose of executing the agreement. In the event that DHL engages subcontractors, DHL will also provide your information to these parties.

GLS

When you place an order with us, it is our responsibility to deliver your package to you. We use the services of GLS for carrying out the deliveries. It is necessary for us to share your name, address, and residence details with GLS. GLS uses this information solely for the purpose of executing the agreement. In the event that GLS engages subcontractors, GLS will also make your data available to these parties.

DPD

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of DPD for carrying out the deliveries. It is necessary for us to share your name, address, and residence details with DPD. DPD uses this information solely for the purpose of executing the agreement. In the event that DPD engages subcontractors, DPD will also make your data available to these parties.

Billing and accounting

Exact Online

For keeping track of our administration and accounting, we use the services of Exact Online. We share your name, address, and residence details, as well as information related to your order. This data is used for administering sales invoices. Your personal data is transmitted and stored securely. Exact Online is obligated to confidentiality and will treat your data confidentially. Exact Online does not use your personal data for any purposes other than those described above.

Purpose of data processing

General purpose of processing

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time - other than at your request - we will explicitly ask for your consent. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us or an oath or legal obligation.

Automatically collected data

Data that is automatically collected by our website is processed with the aim of further improving our services. This data (for example, your IP address, web browser, and operating system) is not personal data.

Cooperation in fiscal and criminal investigations

In certain cases, Apotique B.V. may be required by law to share your data in connection with fiscal or criminal investigations by the government. In such cases, we are compelled to share your data, but we will resist this to the extent permitted by law.

Retention periods

We will retain your data as long as you are our client. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also interpret it as a request for deletion. Based on applicable administrative obligations, we are required to keep invoices with your (personal) data, so we will retain this data for as long as the applicable period lasts. However, employees will no longer have access to your client profile and documents that we have created in response to your assignment.

Your rights

Based on the applicable Dutch and European legislation, you as the data subject have certain rights regarding the personal data that is processed by or on behalf of us. We explain below what these rights are and how you can invoke them. In principle, to prevent misuse, we only send copies and duplicates of your data to the email address we already have on file. In the event that you wish to receive the data at a different email address or, for example, by post, we will ask you to verify your identity. We maintain a record of processed requests; in the case of a deletion request, we keep anonymized data. You will receive all copies and duplicates of data in the machine-readable data format that we use within our systems. You have the right to file a complaint with the Data Protection Authority at any time if you suspect that we are using your personal data inappropriately.

You always have the right to access the data that we (have) processed and that relate to your person or can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file that the data has been adjusted.

Right to restriction of processing

You always have the right to restrict the processing of data that we (have) processed relating to your person or that can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file that the data will no longer be processed until you lift the restriction.

Right to transferability

You always have the right to have the data that we (have) processed and that relates to you or can be traced back to you, executed by another party. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you at the email address we have on file copies or duplicates of all data about you that we have processed or that has been processed on our behalf by other processors or third parties. In such a case, we will likely no longer be able to continue the service, as the secure connection of data files can no longer be guaranteed.

Right of objection and other rights

You have the right to object to the processing of your personal data by or on behalf of Apotique B.V. in certain cases. If you object, we will immediately cease the data processing pending the handling of your objection. If your objection is justified, we will provide you with copies and/or duplicates of the data we process (or have processed) and then permanently cease the processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies.
