About our privacy policy

Apotique B.V. cares deeply about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Apotique B.V. The effective date for the validity of these terms is 26/09/2020; the publication of a new version renders the validity of all previous versions void. This privacy policy describes what data about you is collected by us, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain to you how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you have provided to us.

About data processing

Below you can read how we process your data, where we store it (or have it stored), what security techniques we use, and who has access to the data.

Web store software

Shopify

Our web store was developed with software from Shopify. Personal data that you make available to us for our services is shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Based on the agreement we have entered into with them, Shopify is obliged to take appropriate security measures. These security measures consist of the application of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve its services. Shopify complies with the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies; your data may be processed in the United States.

Web hosting

We purchase web hosting and email services from Argeweb. Argeweb processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. This is not personal data. Argeweb has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Argeweb is bound by a duty of confidentiality under the agreement.

 Email and mailing lists

MailChimp

We send our email newsletters with MailChimp. MailChimp will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website, you will see the ‘unsubscribe’ link. You will then no longer receive our newsletter. Your personal data is securely stored by MailChimp. MailChimp uses cookies and other internet technologies that make it clear whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and, in that context, to share information with third parties.

We use the services of Argeweb for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Argeweb does not have access to our mailbox and we treat all our email traffic confidentially.

Payment processors

Mollie

We use the Mollie platform to handle (part of) the payments in our web store. Mollie processes your name, address, and residence details, and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and, in that context, to share (anonymized) data with third parties. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Mollie’s services for which they engage third parties. Mollie does not store your data longer than is permitted by legal terms.

Shipping and logistics

 PostNL

If you place an order with us, it is our job to have your package delivered to you. We use the services of PostNL to carry out the deliveries. For this, it is necessary that we share your name, address, and residence details with PostNL. PostNL only uses this data for the purpose of executing the agreement. In the event that PostNL engages subcontractors, PostNL will also make your data available to these parties.

DHL

If you place an order with us, it is our job to have your package delivered to you. We use the services of DHL to carry out the deliveries. For this, it is necessary that we share your name, address, and residence details with DHL. DHL only uses this data for the purpose of executing the agreement. In the event that DHL engages subcontractors, DHL will also make your data available to these parties.

GLS

If you place an order with us, it is our job to have your package delivered to you. We use the services of GLS to carry out the deliveries. For this, it is necessary that we share your name, address, and residence details with GLS. GLS only uses this data for the purpose of executing the agreement. In the event that GLS engages subcontractors, GLS will also make your data available to these parties.

DPD

If you place an order with us, it is our job to have your package delivered to you. We use the services of DPD to carry out the deliveries. For this, it is necessary that we share your name, address, and residence details with DPD. DPD only uses this data for the purpose of executing the agreement. In the event that DPD engages subcontractors, DPD will also make your data available to these parties.

Invoicing and accounting

Exact Online

We use the services of Exact Online to keep our administration and accounts. We share your name, address, and residence details, as well as details regarding your order. This data is used to administer sales invoices. Your personal data is sent and stored securely. Exact Online is bound by a duty of confidentiality and will treat your data confidentially. Exact Online does not use your personal data for purposes other than those described above.

Purpose of data processing

General purpose of processing

We use your data solely for the benefit of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you later—other than at your request—we will ask for your explicit consent. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality on the basis of the agreement between them and us or an oath or legal obligation.

Automatically collected data

Data that is automatically collected by our website is processed with the aim of further improving our services. This data (for example, your IP address, web browser, and operating system) is not personal data.

Cooperation in fiscal and criminal investigations

In appropriate cases, Apotique B.V. may be held, under a legal obligation, to share your data in connection with government fiscal or criminal investigations. In such a case, we are forced to share your data, but we will resist this within the possibilities that the law offers us.

Retention periods

We keep your data as long as you are a client of ours. This means that we keep your client profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also consider this a request to be forgotten. Under applicable administrative obligations, we must keep invoices with your (personal) data; therefore, we will keep this data for as long as the applicable term lasts. However, employees no longer have access to your client profile and documents that we have produced as a result of your assignment.

Your rights

Under applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on our behalf. We explain below what these rights are and how you can exercise these rights. In principle, to prevent misuse, we only send copies and duplicates of your data to your email address already known to us. In the event that you wish to receive the data at another email address or, for example, by mail, we will ask you to identify yourself. We keep an administration of completed requests; in the case of a request to be forgotten, we administer anonymized data. You will receive all copies and duplicates of data in the machine-readable data format that we use within our systems. You have the right at all times to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you suspect that we are using your personal data in an incorrect way.

Right of access

You always have the right to inspect the data that we process (or have processed) and that relates to your person or is traceable to it. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data at the email address known to us, with an overview of the processors who hold this data, stating the category under which we have stored this data.

You always have the right to have the data that we process (or have processed) and that relates to your person or is traceable to it, adjusted. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address known to us that the data has been adjusted.

Right to restriction of processing

You always have the right to restrict the data that we process (or have processed) and that relates to your person or is traceable to it. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address known to us that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we process (or have processed) and that relates to your person or is traceable to it, carried out by another party. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or duplicates of all data about you that we have processed, or that has been processed on our behalf by other processors or third parties, at the email address known to us. In all likelihood, we will no longer be able to continue our services in such a case because the secure coupling of data files can then no longer be guaranteed.

Right to object and other rights

In appropriate cases, you have the right to object to the processing of your personal data by or on behalf of Apotique B.V.. If you object, we will immediately stop the data processing pending the handling of your objection. If your objection is well-founded, we will make copies and/or duplicates of data that we process (or have processed) available to you and thereafter permanently stop the processing. Moreover, you have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Google Analytics

Cookies from the American company Google are placed via our website as part of the “Analytics” service. We use this service to track and get reports on how visitors use the website. This processor may be obliged under applicable laws and regulations to provide access to this data. We collect information about your surfing behavior and share this data with Google. Google can interpret this information in conjunction with other datasets and in this way track your movements on the internet. Google uses this information to offer, among other things, targeted advertisements (Adwords) and other Google services and products.
